We recently received a final appellate ruling from the Shanghai Intellectual Property Court, affirming the first‑instance decision that our packaging designs for the “Jinglu Seafoods” triangular and big rice balls were fully copied by competitors. After over a year of litigation, two courts in different jurisdictions have ruled in our favor, finding that the defendants – Weifang Sanyangquan Food Co., Ltd., Changsha Zhongxiang Ruijia Food Co., Ltd., and Changsha Qianke Food Co., Ltd.  deliberately imitated our well‑known product packaging. As industry peers, they were fully aware of the market recognition of our designs but chose to counterfeit them and sell the counterfeit products alongside our genuine ones, with clear intent to free‑ride on our reputation and obtain unfair competitive gains.

The first‑instance court (Shanghai Changning District 

People’s Court) held that our triangular and big rice ball packaging constitutes “packaging with certain market influence” protected under unfair competition law. The Shanghai Intellectual Property Court upheld that ruling.

To strengthen our case, we had secured design patents for the packaging layouts and copyright registrations for the key cartoon characters – “Mituantuan” and “Fanquanquan” – used on the packaging, which provided a solid evidence chain throughout the proceedings. This success reaffirms our confidence in the fair and just intellectual property legal environment in China.

As one of the earliest domestic developers and producers of frozen rice balls, we currently offer five major product lines (triangular rice balls, big rice balls, sushi, rice rolls, and rice burgers) with over 40 kinds of flavor, serving breakfast, snack, and travel occasions. Our products are now available in major supermarket and convenience store chains across China and are also exported overseas.
