Our company’s unfair competition case over the packaging and decoration of “Jinglu Seafoods” rice balls has concluded in Tianjin. The defendants—Weifang Sanyangquan Food Co., Ltd., Tianjin Qianxin Food Sales Co., Ltd., and Tianjin Beichen District Shengxin Food Business Department—withdrew their appeal, so the first-instance judgment is now effective. All three were found to have committed unfair competition.
The court held that Weifang Sanyangquan’s unauthorized use of packaging similar to our “Jinglu Seafoods” rice ball packaging constituted unfair competition, as consumers could easily be confused or misled without special attention. The judgment also recognized that our “Triangular Rice Balls” and “Big Rice Balls” have been sold for a long period, across a wide area, and on a large scale, with considerable market share, reputation, and influence. Through their distinctive design and long-term wide sales, the packaging has gained strong recognizability and can be used by consumers to identify the source, thus constituting packaging with certain influence.
