Protect intellectual property with the law and combat violations of business ethics-- Triangular Rice Ball Packaging Found to Be Extensively Copied; Infringement Upheld on Appeal.

We recently received a final judgment from the Court of Second Instance upholding the original ruling. This marks the conclusion of a year-long legal battle concerning unfair competition in the packaging design of our triangular rice ball product series, with the infringing party ultimately found liable for infringement on appeal.

 

According to the judgment, Weifang Sanyangquan Food Co., Ltd., the infringing party in this case, used not only identification that directly indicate the product's main ingredients, weight, and other characteristics on the packaging of its accused products, but also incorporated cartoon imagery and an overall layout substantially similar to those of the plaintiff's product packaging. This conduct constitutes a clear violation of business norms and commercial ethics, amounting to unfair competition. Consequently, the company must cease the infringement and bear liability for damages. Furthermore, the accused triangular rice ball products were marketed on online platforms using promotional images directly copied from our company's products. The aforementioned actions constitute an infringement of our company's rights and interests.

 

Our company had secured design patents for the packaging layout of this product series and obtained copyright registrations for the main cartoon characters featured on the packaging, namely "Mitutuan" and "Fan Juanjuan." Leveraging these prior rights registrations, we were able to establish a solid and conclusive chain of evidence during the litigation. After the court of first instance ruled that the actions constituted unfair competition, the infringing party appealed. Following a thorough review, the court of second instance upheld the original judgment.

 

This successful outcome is not only a result of our company's systematic efforts in intellectual property protection but also benefits from China's continuously improving legal environment for intellectual property in recent years. From case filing to the final judgment, the judicial process was smooth and efficient, giving us tangible proof that the policy direction aimed at protecting innovation, encouraging original creation, and fostering a clean, orderly market environment is being effectively implemented.
